Abstract

Private International Law Human Rights New Zealand Jurisdiction Access to Justice
In this chapter, the author evaluates the extent to which New Zealand private international law may be inconsistent with New Zealand’s international human rights obligations. The chapter focuses on two main areas of potential conflict – jurisdiction and access to justice, and the recognition and enforcement of foreign laws or judgments that raise human rights concerns – and concludes that, whilst on the whole there appears to be limited cause for concern, there are some areas of uncertainty.
