Abstract

New Zealand Law Trust law common law trusts post-settlement governance entities Māori Iwi tikanga Māori Otago Yearbook of Legal Research
Iwi have effectively utilised the common law trust as a corporate structure for post-settlement governance entities (PSGEs). It is the most common legal corporate entity used for PSGEs, followed by bespoke statute-created entities. Trust law is based on value paradigms that can differ from those of tikanga Māori. Therefore, the trust may not be a perfect fit for the requirements of iwi when they establish and operate a PSGE.
