Abstract
This dissertation will examine the tension between open justice and access to justice in New Zealand's employment jurisdiction. It explores how the online publication of employment decisions can inadvertently deter claimants from pursuing legitimate grievances, and argues that the current use of publication restrictions no longer adequately balances the harms resulting from increased openness.
