Abstract

New Zealand Law Criminal Procedure (Mentally Impaired Persons) Act 2003 unfitness proceedings criminal proceedings protections
This dissertation concerns the adequacy of the current New Zealand processes following a determination that a criminal defendant is unfit to stand trial (with the result that they may be directed into secure psychiatric confinement). It challenges the notion that the current process deals fairly with the defendant and is 'protective' of their interests. It recommends reform of the legislation and suggests how new provisions should be drafted.
