Abstract

Section 27 of the New Zealand Property (Relationships) Act 1976 gives the Court power to make an occupation order in respect of the family home in favour of one spouse or partner to the exclusion of the other. Such orders can only be made if the home forms parts of the relationship property. This article analyses the jurisdictional requirements of s 27 and challenges the perceived lack of jurisdiction where the home is owned by a trust or company.
