Abstract
"Treaty Principles clauses" (TPCs) impose duties on those exercising statutory power to consider or give effect to the principles of Aotearoa New Zealand's Treaty of Waitangi when exercising their power. Presently, the New Zealand Government is reviewing all 28 TPCs in current general legislation. The review is part of New Zealand First Party's coalition agreement with the National Party, which states that the coalition will comprehensively review "all legislation (except when it is related to, or substantive to, existing full and final Treaty settlements) that includes 'The Principles of the Treaty of Waitangi' and replace all such references with specific words relating to the relevance and application of the Treaty, or repeal the references". This statement makes it clear that the review will result in "elaborated" TPCs replacing "broad" TPCs in legislation.
