Abstract:
This paper examines the New Zealand Court of Appeal’s decision in The Great Christchurch Buildings Trust v Church Property Trustees. It concludes that while this decision was a sensible confirmation that the proceedings were misconceived, the inappropriateness of using judicial review as the vehicle of these proceedings signifies a cause for concern that they made it this far.
